Is Delta 8 THC Legal?
Now that you know what delta 8 is — and are perhaps a little bit excited about it — let’s discuss perhaps the most exciting part: delta 8 THC is federally legal. Thanks to the 2018 Farm Bill that created a surge in hemp farming (and thus, CBD products) delta 8 is also allowed to shine. The greater availability of delta 8 is made possible through sophisticated extraction, isolation, conversion, and refinement techniques. The hemp plant only produces a small amount naturally.
So, what’s the catch? In order to remain legal, just like CBD products, the delta 9 THC content in any delta 8 product has to test below the legal limit of 0.3%. Furthermore, as outlined by the Farm Bill, all derivatives, isomers, and cannabinoids in hemp are legal provided that the final products contain less than 0.3% delta 9 THC.
This may cause you to wonder if a lack of delta 9 THC means a lack of physical or cognitive effects. Does that mean that delta 8 THC doesn’t get you high? Negative. But it’s a different high. Delta 8 is considered psychotropic, which has the same essential meaning as psychoactive: something that affects the mind. We’ll get more into this in the next section.

Rather than being viewed solely as a legal alternative to delta 9 THC, delta 8 deserves more credit than that. In fact, according to early studies — we’re talking decades ago — as well as the National Cancer Institute, delta 8 can offer some powerful symptomatic relief.
